Terms of Service
Last updated: September 22, 2026
These Terms of Service ("Terms") are a binding agreement between you and Physweb ("Physweb," "we," "us," or "our") governing your access to and use of physweb.com, including all content, learning modules, interactive exercises, the Metaverse feature, labs, tutoring marketplace, and related services (together, the "Service"). Our collection and use of personal information in connection with the Service is described in our Privacy Policy and Cookie Policy, which are incorporated into these Terms by reference.
1. Agreement to Terms
By creating an account, clicking "I agree," or otherwise accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization, and "you" refers to that organization as well as you individually.
2. Eligibility
You must be at least 13 years old to create an account. If you are between 13 and the age of majority in your jurisdiction, you may use the Service only with the involvement and consent of a parent or legal guardian, who agrees to be bound by these Terms on your behalf. The Service is not directed at children under 13, and we do not knowingly permit anyone under 13 to create an account. If we learn that we have collected information from a child under 13 without the consent required by law, we will take steps to delete that information, consistent with our Privacy Policy.
3. Description of the Service
Physweb is an online physics education platform offering structured learning modules, research-area overviews, interactive exercises, a searchable equations reference, a virtual "Metaverse" space, virtual labs, a marketplace connecting students with tutors, and related tools. We may add, change, or remove features at any time. Some features are available only to users with an active paid subscription ("Physweb Pro"), as described in Section 5.
4. Accounts
You agree to:
- provide accurate, current, and complete information when creating an account;
- keep your login credentials confidential and not share your account with others;
- maintain only one account per person, unless we agree otherwise in writing;
- notify us promptly at info@physweb.com if you suspect unauthorized access to your account; and
- be responsible for all activity that occurs under your account.
We may suspend or terminate your account if information you provide is inaccurate, or if we reasonably believe you have violated these Terms.
5. Free and Paid Plans
A free Physweb account gives you access to a limited set of learning modules, exercises, and features. Physweb Pro is a paid subscription that unlocks additional content and functionality, billed through our payment processor, Stripe. When you purchase a subscription, you will be presented with additional terms covering pricing, billing cycle, automatic renewal, and cancellation at the time of purchase, and those subscription-specific terms are incorporated into these Terms by reference. You are responsible for all charges incurred under your account, and for maintaining a valid payment method on file for as long as your subscription remains active.
6. Your Content
The Service allows you to submit certain content, such as feedback, comments on errata, a display name, and messages or voice communications with other users in the Metaverse (collectively, "User Content"). You retain ownership of your User Content. By submitting it, you grant Physweb a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and use your User Content to operate, provide, and improve the Service (for example, displaying your errata comment to other students, or relaying your voice audio to another user you are speaking with in the Metaverse). You are solely responsible for your User Content and for having the rights necessary to submit it.
7. Acceptable Use
You agree not to:
- violate any applicable law or regulation;
- harass, threaten, impersonate, or abuse another user, including in the Metaverse voice chat or errata comments;
- upload or transmit content that is unlawful, defamatory, obscene, or infringes another person's rights;
- attempt to gain unauthorized access to the Service, other accounts, or our systems;
- reverse engineer, scrape, or use automated means to access the Service except as permitted by our public APIs, if any, or with our prior written consent;
- interfere with or disrupt the integrity or performance of the Service, including the Metaverse's real-time multiplayer infrastructure; or
- use the Service to build a competing product.
We may remove content or suspend accounts that violate this Section, with or without notice.
8. Metaverse and Real-Time Features
The Metaverse is a shared, real-time 3D space. When you join, other users who are online at the same time can see the display name you choose and your character's position and movement, and — if you choose to unmute — can hear your voice, transmitted directly peer-to-peer between participants' devices. Do not share personal information you would not want other users to have, and be respectful of other participants. We do not record or store voice audio, and position data is not retained once you disconnect; see our Privacy Policy for details.
9. Our Intellectual Property
The Service, including its curriculum, exercises, text, graphics, logos, and software (but excluding your User Content), is owned by Physweb or our licensors and is protected by copyright, trademark, and other laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial educational use. You may not copy, modify, distribute, sell, or create derivative works based on the Service without our prior written permission.
10. Third-Party Services and Links
We use third-party providers to operate the Service, including Stripe for payment processing and Google Analytics for usage analytics. The Service may also link to third-party websites, such as national laboratories' research pages or their public data APIs. We do not control and are not responsible for the content, policies, or practices of any third-party service or site. Your use of those services is subject to their own terms and privacy policies.
11. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT EDUCATIONAL CONTENT IS FREE OF MISTAKES. THE SERVICE IS AN EDUCATIONAL TOOL AND IS NOT A SUBSTITUTE FOR INSTRUCTION FROM A QUALIFIED TEACHER OR PROFESSOR; WE DO NOT GUARANTEE ANY PARTICULAR ACADEMIC OUTCOME, GRADE, OR EXAM RESULT FROM USING THE SERVICE.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PHYSWEB AND ITS OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (B) $100. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
13. Indemnification
You agree to defend, indemnify, and hold harmless Physweb and its operators from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your User Content, or your violation of these Terms.
14. Termination
You may stop using the Service and delete your account at any time by contacting us at info@physweb.com. We may suspend or terminate your access to the Service at any time, with or without cause or notice, including for violation of these Terms. Sections of these Terms that by their nature should survive termination (including Sections 9, 11–13, and 15–17) will survive.
15. Governing Law and Disputes
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law principles. You and Physweb agree to submit to the exclusive jurisdiction of the state and federal courts located in Delaware for any dispute arising out of or relating to these Terms or the Service that is not otherwise resolved informally. Before filing a claim, you agree to first contact us at info@physweb.com and attempt to resolve the dispute informally for at least 30 days.
16. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date above and, where appropriate, notify you (for example, by email or an in-product notice). Your continued use of the Service after a change takes effect constitutes acceptance of the revised Terms.
17. General Provisions
These Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between you and Physweb regarding the Service. If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect. Our failure to enforce any right or provision will not be a waiver of that right or provision. You may not assign these Terms without our prior written consent; we may assign these Terms in connection with a merger, acquisition, or sale of assets.
